Negotiation, mediation, arbitration and court proceedings are distinct routes. Arbitration requires a valid basis and a competent forum; mediation does not impose an adjudicated outcome. The appropriate route depends on the contract, urgency, costs and evidence.
Step 3: Court Litigation (If Necessary)
Court competence, current court organisation and available appeals require case-specific procedural review. Not every dispute follows the same route or permits the same review at each level.
Step 4: Enforcement
A favourable judgment does not guarantee recovery: enforcement depends on the enforceable title, procedure and available assets. Interim protection and enforcement measures have separate conditions; insolvency is a distinct procedure and is not simply another form of asset seizure.
