Contract notices in Albania deserve the same care as the agreement itself. A payment reminder, request to remedy a breach or termination notice may have different purposes and consequences. Before sending anything, establish what the notice is intended to achieve and which contractual or legal rules apply.

1. Identify the clause and the required action

Read the signed contract, amendments and relevant annexes together. Check whether the notice concerns information, a request for performance, a contractual remedy or termination. Do not assume that an ordinary reminder automatically produces the effect of a formal notice required for another purpose.

The Albanian Civil Code provides the general contractual framework, including interpretation of the parties’ agreement. The effect of a particular notice requires analysis of its wording, the contract and applicable law. This checklist does not replace mandatory requirements for a specific contract or statutory procedure.

2. Verify the recipient and the delivery channel

Confirm the legal entity, named contact and address specified in the notice clause. Review any valid update of those details. A sales contact or employee who handles invoices may not be the recipient designated for formal notices.

Check whether the agreed method is email, courier, registered post or another channel, and whether copies must go elsewhere. If you use an additional channel for practical reasons, do not assume it replaces the method required by the contract. Obtain advice where the clause is unclear or the contact details no longer work.

3. Check timing before sending

Identify the event that triggers the notice, any relevant deadline and the rule governing when it takes effect. Dispatch, attempted delivery, receipt and acknowledgement are different events. Do not calculate a deadline solely from the time shown in your sent-email folder without checking the applicable rule.

Record the time zone and working-day assumptions where relevant. If a deadline is approaching, seek a prompt assessment rather than relying on a generic notice template. Court, administrative and employment procedures may have separate requirements outside this checklist.

4. Keep the message precise

Identify the contract, relevant obligation and facts relied on. State the action requested and any proposed response date clearly, without inventing a contractual entitlement. Check amounts, attachments and the authority of the signatory. Avoid unsupported allegations or an unintended admission.

5. Keep evidence of what was sent and delivered

Retain the final signed version, attachments, recipient details and delivery records. For email, preserve the original message and any failure notice or reply. For physical delivery, retain the tracking and delivery documents. A screenshot alone may leave important details unclear; preserve the underlying records too.

Keep later responses and actions in the same file. Evidence of dispatch does not necessarily resolve whether a notice was valid or effective. Alba Legal can review the clause, proposed wording and delivery plan before a consequential notice is sent.
